Allgemeine Geschäftsbedingungen

  1. Die Münzen und Gegenstände werden von Fachleuten sorgfältig beschrieben und beurteilt. Die Echtheit wird von der Firma AGORA – KUNST DER ANTIKE garantiert. Sollte sich trotz gewissenhafter Recherchen herausstellen, daß ein Stück gefälscht ist, wird der Kaufbetrag dem Kunden umgehend retourniert. In diesem Fall kann der Kunde aber keinen Schadenersatz geltend machen. Stellt sich die Fälschung einer Münze oder eines antiken Gegenstandes, die/der zum Zeitpunkt des Verkaufs von Experten allgemein als echt angesehen wurde erst nach Jahren aufgrund von neuen Forschungsergebnissen als falsch heraus, kann die Firma AGORA – KUNST DER ANTIKE nicht zur Wiedergutmachung des Kaufpreises oder zum Schadenersatz herangezogen werden. Im Zweifelsfall einer Fälschung wird für Münzen das Expertenurteil der IBSCC (International Bureau for the Suppression of Counterfeit Coins), oder bei antiken Gegenständen der jeweilige Spezialist des British Museum herangezogen.
  2. Es kann nicht ausgeschlossen werden, daß die Online-Angebote verzögert aktualisiert werden. Deshalb bestehen bei eventuell zwischenzeitlich stattgefundenem Verkauf an jemand anderen keine Ansprüche. Ihr Auftrag ist dann verbindlich angenommen, wenn Ihnen eine Bestätigung per e-mail oder Post vorliegt. Zugleich geht Ihnen eine Vorausrechnung zu.
  3. Kunden in den EU-Ländern zahlen für alle Produkte die nicht differenz- oder endbesteuert sind Mehrwertsteuer. Für antike Münzen aus Edelmetall 10 %, für alle anderen antiken Münzen 20 % USt. Für antike Gegenstände ist der USt-Betrag 20 %. Alle Preise sind inklusive der gesetzlichen Umsatzsteuer und werden beim Versand ins Nicht-EU-Ausland abgezogen. Kunden außerhalb des EU-Raumes zahlen keine Mehrwertsteuer (USt), sind aber verpflichtet, die zollrechtlichen Bestimmungen ihres Landes zu beachten.
  4. Wenn Sie zum ersten Mal kaufen, müssen Sie das Kundenkarteiblatt auf dem Bestellschein ausfüllen. Wenn Sie schon Kunde von AGORA – KUNST DER ANTIKE sind, genügt die Bekanntgabe Ihres Namens und der Kundennummer. Danach füllen Sie die Zahlungsmodalitäten aus, die von Ihnen bevorzugt werden. Innerhalb von 24 Stunden erhalten Sie dann die Rechnung (am Wochenende kann es auch 36 Stunden dauern). Nach Zahlungseingang bzw. bei Entscheidung für Nachnahmesendung wird Ihnen die Ware sofort zugesandt. Es besteht auch noch die Möglichkeit, die Ware während der Öffnungszeiten in unseren Geschäftsräumen gegen Barzahlung direkt abzuholen.
  5. Sollten Sie die Sendung nicht innerhalb von 10 Tagen erhalten haben (USA, Japan und Australien innerhalb von 15 Tagen), dann nehmen Sie bitte umgehend mit uns Kontakt auf, damit wir eine Postnachforschung veranlassen können. Alle Sendungen sind versichert.
    6. Sollte die Ihnen zugesandte Ware nicht unserer Beschreibung entsprechen, so senden Sie uns bitte innerhalb von fünf Tagen eine e-mail mit Angabe des Reklamationsgrundes. Sie erhalten auf Wunsch das Geld zurück oder eine Gutschrift für einen neuen Kauf. Liegt der Fehler beim Kunden und die Reklamation wird trotzdem anerkannt, dann erhält der Kunde eine Gutschrift. Bei höherpreisigen Retoursendungen ist der Kunde verpflichtet, uns Aufgabetag und Absendeort zu melden, damit die Sendung von uns versichert werden kann.
  6. Als Verkaufspreis gilt der Eurobetrag. Die anderen Währungen dienen als Richtwert, der jedoch – aufgrund von Kursschwankungen – nicht immer dem exakten Umrechnungskurs entsprechen muss.
  7. Auf alle Rechtsverhältnisse zwischen AGORA – KUNST DER ANTIKE und Benutzern der angebotenen Plattform findet ausschließlich österreichisches Recht Anwendung. Ort und Gerichtsstand ist 1010 Wien.

General terms and conditions

  1. The coins and items are thoroughly judged and described by experts. The genuineness is guaranteed by AGORA – KUNST DER ANTIKE. Should it, nonetheless, be established that a purchased item is a fake, AGORA – KUNST DER ANTIKE will refund the money to the customer. In this case, the customer can not raise any further claim for compensation. Should the purchased item, classified as genuine according to the state-of-the-art knowledge at the time of purchase, years later be classified as a fake – e.g. due to new results of relevant research – AGORA – KUNST DER ANTIKE will not provide compensation for any occurred financial damage or refund money. In case of doubt, an expertise, provided by the IBSCC (International Bureau for the Suppression of Counterfeit Coins), will be referred to, or, with regard to antiquities, the respective expert from the British Museum.
  2. The possibility of delayed actualization of AGORA’s online offers cannot be excluded. Therefore, customers cannot assert their entitlement to any of the objects offered online. A customer’s order is confirmed and binding upon electronic or postal receipt of the order confirmation from AGORA – KUNST DER ANTIKE. Simultaneously, the invoice will be issued to the customer.
  3. Customers in EU countries pay VAT for all goods. The VAT rates are 10% for ancient coins made of precious metal (customers in Germany pay 7%), 20% for all other ancient coins and 20% VAT for ancient items (customers in Germany pay 7%). All prices include the statutory Austrian VAT. The VAT is deducted when goods are being dispatched to non EU countries. Customers outside the EU do not pay the Austrian VAT, but are liable to pay attention to the customs law in their own countries.
  4. First-time customers are obliged to complete the customer’s record on the order form. If you already are customer of AGORA – KUNST DER ANTIKE you just need to indicate name, customer number and desired form of payment. The proforma invoice should be with you within 24 to 36 hours (weekend). After receipt of money transfer (except for “cash on delivery”) we will dispatch the respective pieces immediately. Alternatively, customers can also fetch the pieces during the Gallery’s opening hours.
  5. Should the case occur that you do not receive the consignment within 10 days (USA, Japan and Australia within 15 days), please inform us immediately. We shall immediately start an investigation and localize the package. All consignments are insured.
  6. Should the delivered items not correspond with our description, a respective complaint within five days will be accepted. Money will be refunded or the customer chooses to receive credit for another purchase. Should a purchase turn out to be a customer’s mistake but the return of the item is nevertheless accepted by AGORA – KUNST DER ANTIKE, the customer will receive a credit note. If costly items are being returned to AGORA – KUNST DER ANTIKE, the customer will inform AGORA – KUNST DER ANTIKE about place and date of dispatch for insurance purposes.
  7. Euro is the only valid currency as to pricing of the objects. Other currencies indicated are to be seen as a service of AGORA – KUNST DER ANTIKE and are only of general information value with regard to exchange rate fluctuations.
  8. Austrian law is applicable on all legal relationships and transactions between AGORA – KUNST DER ANTIKE (be it on the premises of the Gallery or on the internet presentation site) and customers. Arbitration: any unresolved dispute, controversy or claim arising out of or relating to these Terms & Conditions shall be resolved exclusively by final and binding arbitration. The place of arbitration shall be 1010 Vienna (Austria) in German language.
